Our established client, an employment law firm, with over two decades of experience, is seeking skilled Settlement Attorneys to join our Settlement Team. The ideal candidates will have a strong interest and proficiency in contracts and settlement negotiations. This role involves managing the settlement process, drafting key documents, motion practice, attending court appearances, and effective client management.
Preferred Qualifications:
- Demonstrated interest and proficiency in contracts and settlement negotiations.
Employment Litigation Tasks:
Case Management:
- Manage case settlement processes and procedures to ensure deadlines are met.
- Handle cases from mediation to post-final approval.
Drafting and Documentation:
- Draft memorandums of understanding, representative and individual settlements, and class notices.
- Draft pleadings, meet and confer letters, and messages to the court.
Motion Practice:
- Conduct motion practice related to settlements.
Court Appearances:
- Attend court appearances and hearings for settlement approvals.
Client Management:
- Communicate proactively with clients, managing their expectations throughout the settlement process.
Skills:
- Good standing with the CA bar.
- Proficiency with Microsoft Office, including Outlook.
- Ability to anticipate each stage of the approval process, being solution-oriented and proactive.
- High attention to detail and meticulous drafting skills.
- Strong time management and organizational skills.
- Effective negotiation skills.
Summary:
The Settlement Team is responsible for efficiently managing the completion of class action, PAGA, and individual settlements. This critical stage involves memorializing and executing key terms of the agreement to ensure it has full legal force and effect. The team must act swiftly to prevent the Defendant from reneging, settling with a different Plaintiff, or experiencing a change in financial circumstances that could prevent the settlement. For representative actions, court approval of settlements is required, and the process can vary by county and department. Therefore, it is imperative that all documents, whether they be the Settlement itself or Plaintiff’s Motion seeking court approval, are drafted to near perfection to avoid delays in court approval.
