The Impact You Will Make
We're looking for a business-oriented attorney to serve as Sr. Counsel, Legal, Privacy & Compliance to guide our dynamic and growing team on day-to-day legal needs as well as increasing complexities around data privacy, security and compliance. Digital Media experience is preferred.
The Sr. Counsel will serve as a trusted advisor to agency leadership and work with business partners across the agency to provide legal guidance and recommendations on a variety of business and risk management matters. You will determine when to engage external counsel and serve as the liaison on more specialized M&A, real estate, employment and election matters. Digital Media Industry is preferred.
You will help build a solid foundation from which we can scale for future growth, including having a point-of-view on best practices, process efficiencies and managing costs, and an aptitude for putting these plans into practice. You will have internal management responsibilities for the Contracts team which we expect to grow over time.
What the Day-to-Day Looks Like
Contracts. You will play a hands-on role, as well as oversee our Director of Contracts, in developing, drafting, reviewing and negotiating contracts (Consulting Agreements, Statements of Work, Amendments, Letters of Authorization) for various types of service engagements in the marketing domain in compliance with company policy.
Commercial Risk/Compliance. You will be responsible for identifying areas of risk and coordinating commercial risk mitigation measures. You will support the maturation and expansion of our corporate compliance infrastructure, including the evolution of company policies and programs and their alignment to organizational controls.
Data Privacy and Information Security/Compliance. You will play a key role in our strategic initiatives by providing data protection counsel, developing data protection compliance infrastructure, and operationalizing compliance policies. You will develop contract language as needed to maintain or strengthen compliance with applicable privacy law and to protect sensitive information.
Product Counsel. You will collaborate with our Insights team to identify potential legal risks and provide risk-mitigation counseling on ad tech products. You will critically analyze complicated data flows and leading-edge ad tech technologies, help implement privacy by design in new ad tech products, and contribute to the development of scalable processes for legal review.
Regulatory Counseling and Training. You will have nuanced understanding of and keep abreast of changes in state, federal and international regulation, legislation, and market expectations related to data privacy, data protection, and election laws at the intersection of privacy, consumer protection, and advertising technology. Related, you will engage with colleagues across the business through training and raising awareness on these developments.
Information Security. You will serve as the primary support for our information security program by partnering with our IT team to address and respond to DSARs, respond to reported incidents that require legal input, maintain existing controls, and identify improvements.
Requirements
- Minimum of 7 years of overall legal experience, with 3+ years of experience leading privacy initiatives
- Juris Doctorate degree from an ABA-accredited law school and membership in at least one state bar
- Hands-on experience reviewing and negotiating a variety of contracts at a fast-paced technology company or advertising agency.
- Advanced working knowledge of data privacy laws (e.g., GDPR and CCPA/CPRA)
- Expert proficiency in drafting contract language without the assistance of content management tools and/or software
- Must possess a strong understanding of both B2B and B2C of the Digital Media ecosystem. This includes a deep knowledge of various advertising technologies and how they are implemented to reach the desired audience with programmatic advertising, social media marketing, or search engine optimization.
- A passion for technology and ability to understand complex technology and product use cases quickly
- Advanced working knowledge of the Microsoft Office Suite (Word, Excel and PowerPoint, including PDF to Word conversions), and with contract management applications
- Ability to communicate via telecommunication and video calls (phone calls, IMs, emails) as well as in person
- Professional demeanor and judgment
- Adaptability and ability to respond to direction as needed
- Strong ethics, integrity, and values including ability to maintain confidentiality with respect to agreement contents and other highly sensitive business matters and projects required
- Ability to adapt to changes, delays, or unexpected shifts in priorities while maintaining focus and productivity in a high-volume environment required
- Ability to prioritize and complete daily workload and projects with minimal supervision and in accordance with deadlines and shifting priorities

BPI offers a comprehensive total compensation package of $160,000- $200,000 for this role, including an annual discretionary bonus and generous benefits. The estimated starting base salary will be based on the level of experience.
